Terms of Service

These Terms of Service ("Terms") govern your access to and use of POLYON ("POLYON", "Service", "we", "us", or "our"), operated by PICSZIO, S.A.P.I. de C.V. ("Company"), a Mexican corporation incorporated under public deed 80,039 dated October 4, 2021, before Jose Maria Morera Gonzalez, holder of Notary Public Office 102 of Mexico City. By accessing or using POLYON, you agree to be bound by these Terms.

1. Acceptance

By creating an account or using POLYON in any form, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. You must be at least 13 years old (or the minimum age required by your local laws) to use POLYON.

2. License to use

Subject to your compliance with these Terms and payment of applicable fees, Company grants you a personal, limited, non-exclusive, non-transferable, revocable license to use POLYON on supported devices for your individual or internal business use.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use at support@polyon.ai. We may suspend or terminate accounts that violate these Terms.

4. Subscriptions and billing

POLYON offers Free, Plus, Pro, and Max subscription tiers. Paid subscriptions auto-renew monthly until cancelled. You can cancel from inside the app at any time; cancellation takes effect at the end of the current billing period. Prices may vary by country and currency. We reserve the right to change pricing with 30 days' notice.

5. User content

You retain ownership of content you submit ("User Content"). You grant Company a worldwide, non-exclusive, royalty-free license to host, store, transmit, and process your User Content solely to operate and improve the Service. We do not sell your User Content to third parties.

6. Acceptable use

You agree NOT to use POLYON to: (a) generate or distribute illegal content, including content depicting minors in sexual contexts; (b) generate instructions for weapons of mass destruction, hacking, or violence; (c) impersonate others or commit fraud; (d) infringe intellectual property; (e) reverse-engineer or scrape the Service; (f) abuse the system through automation, mass requests, or evasion of usage limits.

7. AI outputs

POLYON routes requests to third-party AI models (OpenAI, Anthropic, Google, and others) via OpenRouter and similar providers. Outputs may be inaccurate, incomplete, or biased. You are responsible for verifying outputs before relying on them for important decisions. POLYON makes no warranty about the accuracy of AI-generated content.

8. Third-party services

POLYON integrates third-party AI providers and may integrate other services. Your use of those services is subject to their respective terms. We are not responsible for third-party service availability or content.

9. Termination

You may close your account at any time from Settings → Delete Account. Company may suspend or terminate your account for material breach of these Terms, fraud, abuse, or as required by law. Upon termination, your access ceases; certain provisions (IP, liability, disputes) survive.

10. Disclaimers

POLYON is provided "AS IS" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant the Service will be uninterrupted, error-free, or secure.

11. Limitation of liability

To the maximum extent permitted by law, Company's total liability under these Terms shall not exceed the greater of (a) the amount you paid Company in the 12 months preceding the claim, or (b) USD $100. In no event shall Company be liable for indirect, incidental, special, consequential, or punitive damages.

12. Governing law and disputes

These Terms are governed by the laws of Mexico, without regard to conflict-of-law principles. Any dispute shall be resolved in the competent courts of Mexico City, Mexico, except where you have a non-waivable right to litigate locally under your jurisdiction's consumer protection laws.

13. Changes

We may update these Terms by posting an updated version in the app or on this page. Material changes will be announced in-app at least 14 days before taking effect. Your continued use after the effective date constitutes acceptance.
